Life insurance holder just passed away. Lived in TN. Policy claim has been filed. Policy was taken out in 2005, never missed a payment.
Cause of death was COPD and on death certificate it says did smoking contribute. Doctor checked yes.
The policy is a non-tobacco policy. Insured was not and had not been smoking atleast 2 years prior to application in 2005. Application asked if you had smoked in the past 12 months.
Policy contains a non-contestable clause of two years.
Is there any chance of this getting denied?
Or is this open and shut because it's well past two years?
