Is this a Lep for Part B and D?

I think I already know the answer but a client declined part B since 2010 and kept their $800/MO individual bcbs plan in force BC agent said its better than medicare. Said agent also said there is no penalty once she decides to enroll into Medicare. This person was/is eligible for disability. A/b eff 2010, in A only. She is 63 won't t65 until 2017.



I think it is a lep. Thoughts?
